These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and RANA MOLLA, operating as KAll (“we,” “us” or “our”), concerning your access to and use of the InEx mobile application and all associated services (the "App").
1. Agreement to Terms
By accessing the App, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APP AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. Definitions
- User/You: Refers to the individual accessing or using the App.
- Service: Refers to the InEx mobile application and the backend synchronization features provided via Google Firebase.
- Premium Content: Refers to features unlocked via the Early User program or future subscriptions.
3. No Financial Advice Disclaimer
CRITICAL LEGAL NOTICE: InEx is a personal organization and productivity tool. We are NOT a financial institution, credit union, bank, or licensed investment advisor. The information provided in the App does not constitute financial, investment, tax, or legal advice. Any results or calculations displayed are for illustrative purposes only. You are solely responsible for verifying the accuracy of all financial data and for any decisions made based on such data. We recommend consulting with a certified financial planner before making major life decisions.
4. Intellectual Property Rights
Unless otherwise indicated, the App is our proprietary property and all source code, databases, functionality, software, UI/UX designs, audio, video, text, photographs, and graphics (the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by RANA MOLLA (KAll). They are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of Bangladesh and international conventions.
5. User Account & Security
You may be required to register with the App. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine it is inappropriate or offensive.
6. Prohibited Activities
You may not access or use the App for any purpose other than that for which we make the App available. Prohibited activity includes:
- Systematically retrieving data to compile a database or directory without permission.
- Tricking, defrauding, or misleading us or other users.
- Circumventing security features or using any automated tool (bots, spiders) to scrape or "stress test" the infrastructure.
- Harassing or threatening any of our employees or agents.
- Using the App in any manner that could damage, disable, overburden, or impair the Service.
7. Subscriptions, Payments & Early User Status
- Early User Program: Eligibility for the Lifetime Free Premium is limited to the first 1,000 verified registrants. We reserve the right to terminate this program or adjust limits at our discretion.
- Billing: Any payments are handled by the Google Play Store. We are not responsible for billing errors caused by third-party processors.
- Refunds: All sales are final. Refund requests must be directed to Google Play Support.
8. Termination & Suspension
Without limiting any other provision of these Terms, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the App to any person for any reason including without limitation for breach of any representation, warranty, or covenant contained in these Terms.
9. Limitation of Liability
IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Dispute Resolution & Arbitration
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh. You waive any right to a jury trial or to participate in a class-action lawsuit against us.
11. Force Majeure
We shall not be responsible for any delay or failure to perform any obligation under these Terms if the delay or failure is caused by an event beyond our reasonable control, including, but not limited to, acts of God, war, terrorism, or internet outages.
